DISCLAIMER
• It is your responsibility that you have read my terms and conditions, to which you automatically agree after I have accepted/completed your commission.
• Breach of terms will be informed and may lead to blacklist if persistent.
• DO NOT upload my art for AI training, machine learning, NFT’s or cryptocurrency art.
• I retain the right to decline your commission for any valid reason.

CONTENT RESTRICTIONS
• Generally, I do not draw the following: fetish art, incestuous/"problematic" content, copied styles, or anything that I may find uncomfortable to draw.
• Do check the listings of the commission types I offer for more specific content restrictions.
• Feel free to reach out if you have any questions about the content you want me to draw!

COMMUNICATION
• Work in progress, ideation, situational updates will be made sure to be communicated during the commission.
• Feel free to reach out to any of the following (even when I am not accepting commissions)!

ORDERING
• Please expect a WAIT TIME of a minimum 2 months for your commission.
• Rush fees will be added for deadlines less than 2 months.
• Commissions with deadlines less than 3 weeks in advance will not be accepted.
• Details of the commission will require clear, colored visual references of the full design being drawn; written descriptions are only supplementary.
• You give me permission to replicate the given character designs, reference material and other intellectual property for this commission.
• You ensure that the designs, references and other intellectual property provided are legally obtained and authorized for this commission.
• You must state in advance if you intend to use your commission for commercial purposes, including but not limited to: reproducing and selling the artwork publicly or privately or usage for platforms where you make a profit. This can include Patreon, YouTube, and Twitch.

• You can choose whether or not you give me permission to post WIP’s and the final piece on my social media accounts,
• Please be thorough in explaining your vision to best represent it when I draw it! You may send examples of past artwork you would like me to base it for your commission!

PAYMENT
• A 50% down payment must be paid before any work on the commission is done.Commercial use will have extra fees:
• Twitch/YouTube/Twitter/Patreon promotion - 100% of base price;
• reproducing/selling/merch - 200% of base price• If the commission needs NDA, (Refer to "RIGHTS & USAGE" Section, under Artist General Rights), there will also be an extra fee of 100% of the base commission price.
• More complexity and details of the request may have additional fees, stated on the listing of the commission.
• Pay as asked through the methods being provided to you.

CANCELLATIONS AND REFUNDS
• Failure to pay = blacklist
• If I have not started, you are free to request a full cancellation/refund.
• If I am at or past the sketch stage, you are eligible for a 50% refund.
• If I am past the line art stage, you are not eligible for a refund.
• Issuing a chargeback will result in being blacklisted and will be forbidden from using the art I have drawn for you.
• I have the right to cancel/refund a commission at any given time.

TIMELINE AND PROCESS
• I will only start the commission once the 50% downpayment has been received.
• The commission may take 3 weeks to 7 months depending on the type of commission, complexity and workload.
• You agree to having possible delays and amendments to the timeline.
• You have the right to request for a refund according to the “CANCELLATIONS AND REFUNDS” Section.
• Do take note that I still have personal matters (including personal art) to tend to as I do commissions. Rest assured that I am working on your commission!

REVISIONS
• Initial sketches will be sent for you to choose.
• I will then work on the piece and may provide additional updates, especially for details I would like to clarify.
• Once the artwork is complete, only 3 minor revisions are allowed.
• Major and excessive minor revisions may require additional charges.
• It is your responsibility to tell me about any details I miss when I send you WIP’s.
• For Skeb-like/surprise commissions, no WIP’s will be sent. Minor revisions will be accepted for any missing or incorrect details only.
• These revisions may affect the work’s progress and timeline.
• You may not edit the work after final delivery unless specified in the commission information, project outlines or I have approved prior.

FINAL PIECE
When the commission is finished, the following files will be sent:
• A .png file of your commission.
• A .jpg file of your commission with my watermark; meant for public uploads.• Files you may receive may differ depending on the commission’s complexity.
• Given your permission, I will post the final artwork publicly to promote myself.
• I will try my best to preserve most files for as long as I can!
• However, you are still responsible for saving and holding onto the files you receive.

RIGHTS AND USAGE
Artist General Rights
By default, I retain copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the art piece itself and work in progress on websites, social media, portfolios, public broadcast channels, and more, exempting when some or all of these rights are transferred to you under express agreement (NDA) or project specifications.
I may use rejected work in progress and versions for other projects according to their discretion, under the condition that it does not infringe on your intellectual property rights and ownership of their likeness, character design, branding, identity design or any such trademarks.I retain the non-exclusive rights to sell merchandise and prints of the art piece, unless you have bought exclusive commercial rights regarding the commission.Client Rights for Personal Use Licensed Works
You receive non-transferable usage rights to the commission for personal use.
Personal use includes: display on social media accounts for promotional purposes with no direct monetization or sales, such as social media profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels; or any other instances where no monetization of, or of content featuring, the commission is involved.
You must not claim the artwork as your own and must credit me using my social tag/username/link whenever the commission is immediately displayed publicly including, but not limited to websites, social media profiles and broadcast channels.
You are not authorized to change, modify, edit or use my artwork without my permission.You are not authorized to trace over my artwork in any way, including the use of the artwork as a "base".Client Rights for Commercial Use Licensed Works
Commercial usage rights are not included in general commissions, unless specified in the commission type or project specifications listed (i.e. vtuber models, stream overlays, emotes, and so forth), or you have purchased that we have agreed upon.
Commercial rights may differ for each commission type. Commercial broadcast rights means usage of the commission on streams, videos, advertisements and other content, or any similar monetized instances; commercial distribution rights means selling or reselling the artwork to another party, as a part of any product or merchandising, or on another platform.
Usage of Work for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited.
Additional charges will be required for commercial usage if not included in the project type, listing, or specifications; refer to "PAYMENT" Section regarding additional charges for commercial usage.

INDEMNIFICATION
You are obligated to compensate for claims, losses, damages, and expenses related to the commission usage, breach by the Client of the Agreement, or third-party claims.
If your rights and the terms of this agreement are violated or the commission is not delivered as agreed, due to negligence, I will work to remedy the situation first according to the terms aforementioned and otherwise to your satisfaction.
